A Quiz Question

One for the boffins out there.

There is a grand prix. Let's use hypothetical names.

Bob Smith is leading the race, but gets a drive trough penalty with 10 laps
to go. He must pit within 3 laps. However, his team disagree with the
ruling, and he stays out and completes the race.

After the race, it is decided that the drive-thru was indeed a mistake.
However, the stewards agree that despite their error, he should have served
the drive-thru, and by failing to do so, he is disqualified.

His team are incensed, and appeal to the FIA. Who is awarded the race?
