Lawful Behaviour Can Make You Liable To Arrest - Very Important For Radio Amateurs

Those who believe that 'if you have nothing to hide, you have nothing
to fear' might like to take note.

Radio Amateurs, especially those operating outdoors in a public place,
might like to take a warning from the following, taken from a
real-life recent case concerning a different pastime. Waving one's
licence in the air won't help, and could be construed as obstructive
behaviour. You are advised to pack up your equipment and clear off.


Person A is engaging in a lawful activity in a public place. Person B
doesn't like what Person A is doing, tells him to stop, and calls the
police. The police turn up, and agree that the activity of Person A is
lawful.

However, the police add, Person A continuing to carry his lawful
activity will render him liable to arrest.

Why?

Because his continuing the activity could be viewed as an
'inflammatory act' against Person B, making Person A liable to arrest
for Breach of the Peace under the Public Order Act, even though his
activity was, and was seen to be, lawful, the police later saying that
"...no offences were disclosed. The [person] was appropriately advised
regarding his conduct."

You have been warned. Failing to cease a lawful activity when told to
do so can seriously jeopardise the rest of your life - CRB, ISA, DNA,
fingerprints, mugshots, no prospects of a job ever again. Slink off,
relieved that things didn't get any worse.
