...except that the 'child porn' is " Level One of the Copine Scale",
i.e. stuff that no reasonable person would regard as indecent. Also
they tried to prosecute him on a trumped up "breach of the peace"
charge for "taking photographs of adults and children without their
consent or knowledge."

POLICE discovered thousands of pornographic pictures of children, some
as young as five, when they seized computer equipment belonging to a
66-year-old Perth man.

The sheriff court was told this week that officers received
confidential information that William Ferguson, of Potterhill Gardens,
was in possession of indecent images and obtained a search warrant.

They went to his house at 8.40am on Wednesday, February 24, and entry
was gained "without force."

Officers removed a hard drive and tower unit, as well as CDs and DVDs,
and sent them off to their Technical Support Unit for examination.

The equipment contained 1014 'live' images and 1140 'deleted' images,
which were subsequently recovered.

"The ages of the children ranged from five to 16," depute fiscal
Janine Bates told the court.

"The material recovered was found to contain indecent images falling
into Level One of the Copine Scale."

The rating system is used in the UK to categorise the severity of
child porn pictures.

Category One is the least severe, with five at the top end of the
scale.

The hard drive and two CDs also contained a further 444 images. They
included images of female adults and children.

"Although it would seem that these persons were unaware the
photographs had been taken, these images were not of an indecent
nature," added the depute fiscal.

Ferguson subsequently attended voluntarily at Perth police station
where he cautioned and charged.

He admitted downloading some indecent images of children "a while ago"
but stated he had taken some of them off his computer.

"He stated that he didn't specifically look for child images and he
seemed to understand what was meant by a child - ie a person under
18," added Ms Bates.

Ferguson pled guilty to being in possession of indecent photographs of
children at his home on February 25 this year.

A not guilty plea to a second charge of committing a breach of the
peace by taking photographs of adults and children without their
consent or knowledge was accepted by the prosecution.

That charge was alleged to have taken place on various dates between
August 17, 2007, and January 23, 2009, at Lochie Brae, Perth, and in
the public car park of the Drumhar Health Centre in the city.

Ferguson will be sentenced on November 4 after social inquiry and
community service reports have been prepared.

Sheriff Michael Fletcher also called for an assessment on the accused
from the Tay Project, which aims to rehabilitate sex offenders.

Ferguson had his name added to the Sex Offenders' Register. The length
of time it remains there will be determined at his next court
appearance.

Solicitor Paul Ralph reserved his plea in mitigation until then.
