Hi, I was wondering if anyone could offer me some advice. The property which we own and live in is ex-local authority housing and when it was transferred to the original purchasor the local authority put a restrictive covenant into the title deeds which states that the land must only be used as a single dwelling house. Since that time, opposite, the local authority have sold off an old people's home and a developer has built 28 houses on the land, the designs of which would easily fit onto our side garden and therefore be in keeping with the "local development". So we would like to investigate removing the restricive covenant and applying for planning permission for the side garden (which would become "in-fill" in planning terms I believe). Does anyone know where to start with this and the likely hood of success? Can anyone offer advice or experience of being successful with similar?
