The ISA Referral Guidance has been updated

The Independent Safeguarding Authority (ISA) has been created to help
prevent unsuitable people from working with children and vulnerable
adults. Since 31 March 2008, the ISA has been providing advice on
barring decisions for List 99, the Protection of Children Act (PoCA)
list and the Protection of Vulnerable Adults (PoVA) list to the
Secretaries of State for Children Schools and Families (DCSF) and
Health (DH).

From October 12th 2009, a new duty to share information has been
introduced under the Vetting and Barring Scheme. From that date
employers, social services and professional regulators will have to
notify the ISA of relevant information so that individuals who pose a
threat to vulnerable groups can be identified and barred from working
with these groups.

To help you understand the new referral process before it is launched
on October 12th, we have published a guidance document and the new
referral form.

The guidance sets out:

* the key elements of the new referral process
* the circumstances under which a referral should be made
* the legal responsibilities of employers, including the paid and
voluntary sector and also employees.
* the main points of the law in relation to referrals

The ISA Referral Guidance has been updated. To identify the parts that
have been updated please see the ISA Referral Guidance Change Log
under In this Section.

The ISA is aware that the Communication Workers Union (CWU) has
announced two 24-hour nationwide postal strikes that will start on
Thursday 22 October. If the action does go ahead we know that
referring parties will be making the appropriate alternative
arrangements based on their own organisational requirements and their
data protection and safeguarding policies.  If any organisations or
individuals need further information from the ISA, for example if they
are planning to send any correspondence to the ISA via courier, please
contact us through the Vetting and Barring Scheme contact centre on
0300 123 1111; pressing the first option to speak to an advisor.

In addition the ISA has made its own alternative arrangements to
ensure that its own mailing requirements will be unaffected by any
industrial action and is able to communicate effectively and timely
with organisations and individuals.
